Portogallo: la Corte d'Appello invalida il test PCR e la quarantena
La Corte d'appello portoghese di Lisbona ha revocato una quarantena imposta per l'inaffidabilità del test PCR. Se questa sentenza stabilisce un precedente, la politica della paura del Coronavirus potrebbe presto crollare come un castello di carte.

Nonostante sempre più scienziati rinomati stiano esprimendo dubbi sui test PCR, continuano ad essere utilizzati in massa per rilevare una presunta "infezione" dal Coronavirus. Malgrado tutte le preoccupazioni fondate, questi test continuano a fornire cifre record di infezioni, che dovrebbero giustificare le restrizioni e i lockdown nei vari Paesi.
Un fatto sorprendente è accaduto in Portogallo: l'11 novembre 2020, la Corte d'appello di Lisbona ha dichiarato illegale la quarantena di 4 portoghesi. Di queste quattro persone, una era risultata positiva al Covid-19 tramite un test PCR, e anche le altre tre erano state messe in aquarantena come contatti stretti. Questa procedura è una pratica comune in molti paesi.
La Corte ha fatto riferimento allo studio scientifico di Rita Jaafer e dei suoi colleghi. Questo studio è stato pubblicato sull'Oxford Academic Journal il 28 settembre 2020 ed è stato realizzato da un gruppo di alcuni dei principali esperti europei e mondiali in materia. La Corte ha concluso che "se il test PCR è positivo con una soglia di ciclo di 35 o più (come avviene nella maggior parte dei laboratori americani ed europei), la probabilità di infezione effettiva è inferiore al 3%. La probabilità che una persona sia dichiarata un falso positivo è del 97% o più". Alcuni preparati non hanno nemmeno una soglia, il che significa che qualsiasi campione può essere considerato positivo. Questo può sembrare spaventoso, ma non è davvero sorprendente. È in linea con le dichiarazioni di molti scienziati rinomati, come Mike Yeadon, che per 16 anni era vicepresidente e direttore della ricerca medica alla Pfizer, il secondo più grande gigante farmaceutico del mondo, o come Stefano Scoglio, candidato al premio Nobel per la medicina 2018. Tutte e due hanno accusato questa problematica dei test PCR diverse volte nei mesi passati.
Tuttavia, secondo l'Istituto Robert Koch gli attuali sistemi di rilevamento PCR sono considerati indispensabili e sono standard diagnostici. Attualmente, i regolamenti in Svizzera e Italia richiedono che tutte le persone che risultano positive al virus siano messe in quarantena. Tuttavia, la Corte d'appello portoghese respinge categoricamente una tale procedura nella sua sentenza. Secondo la Corte, la prova di un'infezione virale non sarebbe ammissibile senza l'intervento di un medico registrato, il che a sua volta mette completamente in discussione la pratica di tanti Paesi. La Corte chiarisce che considera la quarantena come una privazione della libertà. Riferendosi ai diritti fondamentali, la Corte afferma inoltre:
"Attualmente, l'energia del paese è concentrata sull'emergenza. Ma la necessità di proteggere i diritti fondamentali, anche e soprattutto nelle emergenze, richiede che i tribunali svolgano il loro ruolo [...] per garantire e proteggere i diritti di tutti. Quello che facciamo o non facciamo oggi per mantenere il rispetto dei principi fondamentali del sistema determinerà il nostro futuro."
La sentenza della Corte d'appello di Lisbona potrebbe creare un precedente che altri tribunali europei potrebbero seguire. In Sicilia è già stata lanciata una denuncia collettiva in 9 città. Resta da vedere come si svilupperà la situazione. Dopo tutto, il test PCR e i suoi risultati positivi sono alla base di tutto lo scenario di paura che stiamo vivendo. Crolla la credibilità del test PCR, crolla anche l'intera politica del Coronavirus ... come un castello di carte.
