So the question keeps coming up, the question based on: "What have we actually achieved?" So, there are people on the streets in winter, in the snow, etc., the Monday demonstrations across Germany, which are taking place again today. So the people who show themselves, who are out there, that is an extremely important contribution and wants to stay that way, must stay that way, and so first of all from this point a very heartfelt thank you to all the people who regularly hold their demonstrations all over Germany, who do not want to and will not give up, because, as I said: "It is not over, it continues", as this press conference also expresses very clearly. And we encourage everyone to keep going, i.e. for ourselves, we are doing something that is exactly what is being asked for here, and we are very optimistic and in good spirits, as you can see, we are ready to fight within the framework of these possibilities, the legal possibilities that we have. And we trust that we will get away with it, because injustice will not be sustainable in the long term.
We also have to know that the public prosecutor's office is dependent on the government, as is the RKI. They are bound by instructions, the public prosecutor is bound by instructions, i.e. you can instruct the public prosecutor: "You let the left-wing... they can get harmless stories as a court case and the right-wing the violent ones," depending on how you want it from the public prosecutor. We can't change that, it's politically desired, and we're currently experiencing that in these political court cases with the mask certificates. Here the public prosecutor is called upon to do certain things.
We expect the judges to keep the role that is assigned to them legally, under German law. If they do that, then the matter would look very different. And that's where we see a gap for us as a human rights movement, to make the judges aware in the trials: What is actually a political trial here and what isn't?"
I can also comment on that. A non-political trial would be an evidence-based hearing in a court case. So, assuming that the RKI measures were correct, which was all there, and then you negotiate on that - then you say yes, the RKI said that and that is all correct. But we know that the RKI said something completely different. That was not a policy, it did not decide on the basis of the RKI documents. That is, it is a political decision, a purely arbitrary political decision without any evidence and that means for us:
Every court case based on such a political decision is a political process.
And that is how we see it, and that is why we are currently collecting the court cases that were made on this basis. The judges could not have known that beforehand, because they were also defeated by this government statement. Now we have the RKI papers, now we have a completely new legal basis and with that we are now going forward and saying: "No, on that basis it is a political process," and then we are asked.
Uwe Kranz:
Bianca Witzschel was sentenced to two years and eight months today.
This shows that we are not on the right track here and that the judiciary is not thinking for the life of us about holding, conducting and issuing evidence-based court proceedings – court rulings – and that we really still have a lot of work ahead of us to put things right, to get things straight.
Karl Hummitzsch:
I have had this experience in the current court case in Hamburg. The really tough part is runningt in Hamburg, in court. And we have compiled documents that we want to make available to the court. The fact is that the judgment that you (Uwe Kranz) are referring to today is still based on the old situation. In my opinion, the RKI documents etc. were not included in the form in question, because otherwise it would be clear that the RKI - they're not stupid, they know just as well as we do. So everyone is of the same opinion. That's one thing.
It must be made clear that this is a purely politically motivated decision, supported by the politicians alone. And so it is clearly a political process and we don't want that in Germany. We don't want political prisoners and things like that, which would be the case in this case.
I assume that the court believes it can pull out old evidence here. We won't go along with that. And these are the processes that we are now looking at and we are assuming that all mask processes are based on this old basis and so - we have everything ready - and we are going ahead with it. We have the cases, I have them all. And we are intervening and seeing what options we then have as a human rights organization. It is a completely different approach than that of a lawyer or prosecutor or judge. We are a human rights organization. And that is a completely different area.
