Time and again, people who feel powerless and ignored by the state and authorities turn to KLA.TV with their needs.
They are confronted with the enforcement of measures and the suffering of children under masking and testing compulsion, especially in schools.
In recent days, however, Germany has experienced a wave of courageous rulings, decisions and statements by judges, lawyers and even public officials who see the constitutional state threatened as never before in the postwar period and are now standing up for the good of the people.
Beginning of March, the "Network of Critical Judges and Prosecutors" (KRiStA) was founded in response to this. The network advocates the full restoration of fundamental rights and the principle of proportionality. "It's time to stand up and speak out," said Judge Oliver Noelken. In case governments and authorities arbitrarily restrict the freedom of citizens and the parliaments of the respective federal and state governments are no longer capable of effectively controlling them, the judiciary must prove itself to be the constitutional state’s last line of defense”, he said.
The majority of Corona measures were based on questionable foundations: they were of dubious benefit, largely overshot the case, or were completely incompatible with the spirit of a free state.
Spokesman Oliver Noelken called on his colleagues in the courts and prosecutors' offices to stand up for freedom and the rule of law to show backbone and passion, even under political pressure: "We, the judges and prosecutors don't serve the government, we serve the law."
Dr. Pieter Schleiter, a criminal judge, for instance, is currently filing a constitutional complaint with the Federal Constitutional Court against the new version of the Infection Protection Act and several Corona regulations.
The motivation behind it is the threatening implementation of the most far-reaching restrictions on basic rights – since the Federal Republic of Germany came into existence – and which should be introduced with the new law.
Recently, the association "Lawyers for Clarification" addressed the members of the German National Parliament with an urgent appeal not to approve the planned new version of the Infection Protection Act, because its approval would mean the end of democracy.
Jens Gnisa, director of the Bielefeld District Court and former chairman of the German Judges' Association until 2019, has been unusually clear in his criticism of the German government's plans to expand the federal government's authority in the Corona crisis: “You rarely see me stunned. But now the time has come. The federal government is clearly overshooting all boundaries of proportionality.”
In his view, and I quote, "...the law is likely to be the most profoundly far-reaching cut of” fundamental rights in recent decades."
Lawyer and criminal defense attorney Frank Hannig: "The rule of law is the foundation of what we do professionally as lawyers, but it is also, in my opinion, actually the foundation of our society.
[...] Without this rule of law, without this equal and well thought-out legislation for everyone, a democratic society will no longer function.
And I'm increasingly worried because, whether by negligence or on purpose, this firm constitutionality is being messed with [...] If we don't fight for government by rule of law, we won't survive as a parliamentary democracy, and that scares me a lot."
Currently, dear viewers, there are groundbreaking sentences and impulses coming from judges and lawyers in Germany. listen tothe following examples , which can also be found in detail on the platform Reitschuster.de:
1. Hanau lawyer Holger Fischer is mobilizing against compulsory mask-wearing:
He sent a letter to about 1,000 school principals in the state of Hessen. The letter went as well to the schools’ parents councils and also to the staff councils of the educational institutions. In his letter he highlights, among other things, liability and criminal law issues:
Whereas the strictest rules apply to the wearing of masks in the context of workplace safety, they apparently play no role in connection with Corona. School principals and teachers are rarely aware that they are responsible for the safety of students and may be liable for damage or subject to prosecution, if damage occurs. Parents and teachers who wish to defend their children's interests can find the letter under:
https://reitschuster.de/post/maskenpflicht-fuer-alle-schueler-ein-rechtsanwalt-macht-mobil/
Another aspect that currently worries many parents and teachers is self-testing at schools. As early as after Easter, mandatory testing at school was introduced in 11 German federal states. Attorney Holger Fischer commented on the subject.
“The tests are neither suitable nor approved for children”. In view of the “completely unresolved” liability issues, he advises teachers: “Remonstrate! You run the risk of being held criminally responsible and facing recourse for eventual damage claims.”
A fact sheet to help argue the case concerning rapid testing can be found under the following link:

2. Landmark ruling in Weimar:
In response to a complaint filed by two parents, the District Court in Weimar ruled that the obligation for students to wear masks, to observe minimum distances and to conduct rapid tests at the two sued schools was unlawful. The judge justified this with a serious hazard to child welfare: "... Because the obligation to wear face masks during school time and to keep distances among themselves and to further persons does not only jeopardize the children’s spiritual, physical and mental well-being , but beyond that it actually even damages them at present."
At the same time this obligation was violating numerous children’s and parents’ rights under the prevailing law, the Constitution and international conventions.
The judge concluded that school’s administrators and teachers could not claim to act on the authority of state
This is because these regulations are unconstitutional and therefore null and void.
The entire court decision is 178 pages long and is a general settling of accounts with the Corona regulations at schools.
You can find it under the following link:
https://reitschuster.de/post/hammer-gerichtsentscheid-in-weimar-keine-masken-kein-abstand-keine-tests-mehr-fuer-schueler/
3. Court in Weilheim overturns compulsory mask wearing for children
Following Weimar, the District Court in Weilheim, Bavaria, has now ruled similarly. In a temporary injunction, the court prohibited the school administration of a secondary school to enforce the wearing of a mouth-nose masks in a given individual case.
The court based its decision on an expert opinion by Prof. Christof Kuhbandner and Dr. Ines Kappstein, according to which 68 percent of the children complain of impairments caused by mask wearing.
In addition, there was a risk of a "mask mouth", which might lead to cavities bad breath and gingivitis, among other things. There were also dangers for the children’s development due to the disruption of non-verbal communication. There was no evidence that face masks of various types may significantly reduce the risk of infection by SARS-CoV-2, the expert said. The Court brought the message home: It must be clear to all those who force a child to wear a mask over a longer period of time that they cause a threat to its well-being and thus interfere with its rights without justifiable reason (...). A principal or teacher who nevertheless does this in the knowledge of the associated dangers will not be able to plead ignorance of the danger in the event of an actual injury, or that he was forced to do so by some infection protection regulation or hygiene concept.
4 Courts overturn nighttime curfews:.
In various regions, such as Hanover or the Märkischer Kreis, night-time curfews are currently being overturned. Reason: unclear scientific evidence and disproportion of measures.
Conclusion: After an initial period of cautiousness judges and lawyers are now coming together to defend the law, despite pressure from the state and defamation in the media. They network and issue ground-breaking rulings. By means of elaborate expert assessments and judgments, they provide a good foundation that other lawyers, principals, parents, etc. can access. Investigative freelance journalists, such as Boris Reitschuster's team, make these developments accessible to a broad public, so that established media, after an initial silence, are repeatedly forced to report on them as well.
You too, dear viewers, please assume responsibility by using all possible means at your disposal!
Additionally, we recommend an interview by the medical expert Dr. Ronald Weikl with the long-time family and juvenile judge Hans-Christian Prestien: “Child protection lawsuits might end mandatory mask wearing”. In this interview, existing regulations such as the wearing of masks or testing by educators and teachers of entrusted children are examined from a legal perspective. It provides parents, teachers, and educators with an important guide enabling them to secure the child's legally mandated well-being.
With the Corona crisis, our freedoms and fundamental rights are being lost, and the basis of the constitutional democracy under the rule of law is in danger. “Aren't there any judges, lawyers and prosecutors who recognize this and take action against it?” Yes, there are!
