Compact ban: A massive attack on press freedom | Interview with Joachim Steinhöfel

I welcome Joachim Steinhöfel to our discussion today, certainly one of the best-known and most successful media lawyers in Germany. It is about the fact that the Minister of the Interior, Nancy Faeser, banned the magazine Compact and its publisher and at the same time carried out searches of the editorial office and private rooms. We have to stand together, no matter what the issue is, and of course this is a magazine where no one says: "Yeah, wow, I like reading Compact - what a disgrace." What is written there is, as far as I have seen, extremely unappetizing and disgusting, but that doesn't matter. As far as I can tell, it is almost entirely within the framework of basic rights. Then you can write that, and if you say that basic rights only apply to those who write the right thing, then we might as well throw them in the trash. So, answer: Everyone should, after examining for themselves what the basis of this ban is, only with regard to publications with the usual dispensation - yes, really bad, really terrible - I did that too - but you can say that. And what the minister is doing here, she is the real - she is a greater danger to the free democratic basic order, Ms. Faeser, than this magazine. I simply printed out a short passage from a decision of the Federal Constitutional Court that is not very old - from 2018 - and I'm going to read it out now. I've done that so often in this interview. It actually says in no uncertain terms what you are allowed to do: The possible confrontation with disturbing opinions, even if they are dangerous in their intellectual consequences and even if they are aimed at a fundamental overturn of the existing order, is part of the free state. Protection against the poisoning of the intellectual climate is no more a reason for intervention than protecting the population from an insult to their sense of justice by totalitarian ideologies or an obviously false interpretation of history. A trivialization of National Socialism as an ideology or an offensive interpretation of history of this period alone do not justify criminal liability. Says the Federal Constitutional Court.
