In response to a complaint filed by two parents, the District Court in Weimar ruled that the obligation for students to wear masks, to observe minimum distances and to conduct rapid tests at the two sued schools was unlawful. The judge justified this with a serious hazard to child welfare: "... Because the obligation to wear face masks during school time and to keep distances among themselves and to further persons does not only jeopardize the children’s spiritual, physical and mental well-being , but beyond that it actually even damages them at present."
At the same time this obligation was violating numerous children’s and parents’ rights under the prevailing law, the Constitution and international conventions.
The judge concluded that school’s administrators and teachers could not claim to act on the authority of state
